CMS Reminds Providers of Residents’ Rights Related to Voting
At the end of September, the Center for Medicare and Medicaid Services (CMS) released QSO-24-21-NH, Compliance with Residents’ Rights Requirement related to Nursing Home Residents’ Right to Vote. The purpose of the memo is to affirm the regulatory expectation that nursing home residents can exercise their right to vote without interference, coercion, discrimination, or reprisal from the facility.

Mandatory reporting requirements regarding abuse, neglect, exploitation or abandonment of adults covered by the Adult Protective Services Act of 2010
To notify employees and administrators of facilities (including an organization or group of people that uses public funds and is paid, in part, to provide care and support to adults in a licensed or unlicensed setting) of the mandatory reporting requirements set forth in the Adult Protective Services (APS) Act. Forms and instructions are available on the Department’s website at www.dhs.pa.gov under Report Abuse>Adult Protective Services.

PA DHS: Abuse Reporting Clarified
The information is intended to provide clarification to Personal Care Homes and Assisted Living Residences on reporting requirements in 55 Pa Code Chapter 2600, 55 Pa Code Chapter 2800, Act 79 of 1987 (Older Adult Protective Services Act), and Act 70 of 2010 (Adult Protective Services Act) Administrators or employees who have reasonable cause to suspect that a resident (any age) might be a victim of abuse must comply with the requirements listed within.
