The document outlines the mandatory reporting procedures and definitions related to abuse of older adults as mandated by the Older Adults Protective Services Act in Pennsylvania.

To notify employees and administrators of facilities (including an organization or group of people that uses public funds and is paid, in part, to provide care and support to adults in a licensed or unlicensed setting) of the mandatory reporting requirements set forth in the Adult Protective Services (APS) Act. Forms and instructions are available on the Department’s website at www.dhs.pa.gov under Report Abuse>Adult Protective Services.

The information is intended to provide clarification to Personal Care Homes and Assisted Living Residences on reporting requirements in 55 Pa Code Chapter 2600, 55 Pa Code Chapter 2800, Act 79 of 1987 (Older Adult Protective Services Act), and Act 70 of 2010 (Adult Protective Services Act) Administrators or employees who have reasonable cause to suspect that a resident (any age) might be a victim of abuse must comply with the requirements listed within.

Pennsylvania's long-term care system is facing a crisis due to insufficient Medicaid reimbursements, particularly compared to neighboring states, and an outdated budgeting tool called the Budget Adjustment Factor (BAF) which House Bill 1310 aims to address by establishing a stable BAF floor. Fixing the Medicaid reimbursement issue and modernizing the BAF is crucial for stabilizing the system, supporting caregivers, and ensuring adequate care for the growing senior population.

BHSL issued a Regulatory Clarification to provide guidance to PCHs and ALRs that utilize multi dose medication packaging, such as sachets or roll-packs when a medication is discontinued.

The Nursing Facility Quality Incentive program rewards nursing facilities for meeting certain quality metrics based on clinical and utilization measures. Facilities earn points for achieving benchmarks and improvements, and must meet eligibility criteria including Medicaid participation, performance on at least one metric, and 2024 webinar attendance. Attestation forms for webinar attendance are due by Friday, March 14.
